1. Enrollment in the Program

1.1 To join the Donkey Chats Affiliate Program, you must submit an application through our website.

1.2 We reserve the right to accept or reject any application at our sole discretion.

2. Affiliate Responsibilities

2.1 You must promote Donkey Chats ethically and honestly.

2.2 You may not make false claims, misleading statements, or misrepresent Donkey Chats in any way.

2.3 You are responsible for ensuring that your marketing activities comply with all applicable laws and regulations.

3. Commission Structure

3.1 Affiliates earn a commission based on the number of paying customers they refer. The commission rate increases as affiliates reach sales milestones:

• 1-10 Sales: 10% commission per sale
• 11-25 Sales: 15% commission per sale
• 26+ Sales: 20% commission per sale

3.2 Commission payments are calculated based on verified sales.

3.3 Self-referrals or fraudulent referrals will result in forfeiture of commissions.

4. Payment Terms

4.1 Payments will be processed monthly via PayPal.

4.2 A minimum payout threshold of $50 applies. If the affiliate's balance does not reach this threshold, it will roll over to the next month.

4.3 Commissions are subject to a 30-day holding period to account for potential refunds or chargebacks.

4.4 We reserve the right to withhold payments if we detect fraudulent activity or violations of these terms.

5. Refund & Chargeback Policy

5.1 If a referred customer requests a refund within 30 days of purchase, the corresponding commission will be revoked.

5.2 If a chargeback occurs, the affiliate will not receive a commission for that transaction.

6. Cookie Tracking

6.1 Referral tracking is done via cookies that last 30 days. If a user completes a purchase within this period using the affiliate's link, the commission is credited.

6.2 If a customer clicks multiple affiliate links, the last-clicked affiliate receives the commission.

7. Prohibited Activities

7.1 Affiliates may not engage in spam marketing, including unsolicited emails or social media spam.

7.2 Use of paid advertisements (such as PPC campaigns) that bid on Donkey Chats trademarks is prohibited.

7.3 Any deceptive or unethical marketing practices may result in termination from the program.

8. Intellectual Property

8.1 Affiliates may use our approved marketing materials but may not modify our logos, branding, or other intellectual property without prior consent.

8.2 You may not register any domain names, social media accounts, or advertising campaigns that include our brand name without permission.

9. Inactive Accounts

9.1 If an affiliate does not generate a sale within six months, their account may be deactivated.

9.2 Affiliates may reapply after deactivation but are not guaranteed reinstatement.

10. Termination

10.1 We reserve the right to terminate any affiliate account at our discretion, with or without cause.

10.2 Upon termination, any unpaid commissions may be forfeited.

11. Limitation of Liability

11.1 We make no guarantees regarding your ability to earn commissions.

11.2 We are not responsible for any indirect or consequential damages arising from participation in the program.

12. Changes to Terms

12.1 We may update these terms at any time. Continued participation in the program after changes constitutes acceptance of the new terms.

13. Dispute Resolution

13.1 Any disputes related to the affiliate program will first be attempted to be resolved through informal negotiations.

13.2 If unresolved, disputes will be handled through binding arbitration in California, United States.
